A motorist from Connecticut who was allegedly drinking and driving in Westchester over the weekend is facing a DWI charge after he threw up outside his car window during a traffic stop in Scarsdale, police said.

While on patrol on Post Road shortly after midnight on Sunday morning, an officer spotted a car speeding through the village with no headlights, swerving repeatedly over the double yellow lines near Scarsdale Police Headquarters. Officers were eventually able to get the driver, Ridgefield resident, Robinson Rueda, to stop near Mamaroneck Road.

During the subsequent stop, Rueda, 39, said he was heading home from White Plains. The officer reported that his speech was slurred, he had alcohol on his breath and his eyes were “glassy and bloodshot.” When asked how many drinks he had, he replied “two.

According to police, while the officer was in his car doing a computer check of Rueda’s driver’s license, he leaned out of the driver’s side window and vomited. When the officer returned to the car, he said that there was vomit on Rueda’s left shoulder and upper arm.

Rueda went on to fail several Standardized Field Sobriety Tests, and a breathalyzer found his blood alcohol content to be at .169 percent, more than double the legal limit. Rueda was arrested at the scene and taken to Scarsdale Police Headquarters for processing. A second test found that his BAC had risen to .19 and Rueda was charged with driving while intoxicated and aggravated DWI with a BAC greater than .18 percent.

Following his arraignment, Rueda was released and is scheduled to appear in Scarsdale Village Court on Wednesday, Sept. 26 to answer the charges.
