Seitz was arrested and charged earlier this month after the death of his son, Benjamin, 15 months old, on July 7. The boy was left in a hot car for most of the day while his father worked. Kyle Seitz apparently forgot to drop the boy off at day care.

Seitz appeared Friday in Danbury Superior Court with his attorney, Robert Gulash.

He faces up to a year in prison if found guilty of the misdemeanor charge.

Seitz, 36, turned himself in at Ridgefield Police headquarters at 4 p.m. Tuesday, Nov. 11, after learning there was a warrant for his arrest. He appeared in court Wednesday, Nov. 12, but did not enter a plea.

Lindsey Rogers-Seitz, the boy’s mother, and their two daughters moved to an undisclosed location out of state. Kyle Seitz has been ordered to not leave the state, turn in his passport and have no unsupervised visits with his other children, according to the court.

Temperatures reached 88 degrees on the day the boy died. It was not clear how long he was in the car in the parking lot at his father's workplace. Seitz took the boy directly to Danbury Hospital when he found him in the car at the end of his workday. The death was ruled a homicide in August by the state medical examiner's office.
