On March 2 the restaurateur who had been victimized staked out his restaurant and saw two men stealing his used oil, police said. The men used an unmarked van which contained siphoning equipment and two large tanks for containing the oil.

The restaurateur followed the van to another restaurant, and later called police. Officers caught up to the van a short time later at Stew Leonard's. The two men were arrested and the van was seized as evidence, police said.

Jose A. Martinez, 44, and Mario J. Garcia, 47, were both charged with two counts of sixth-degree larceny, two counts of criminal trespass, and conspiracy to commit sixth-degree larceny. They were both held on a $1,000 bond.
