Kyle Seitz, 37, pleaded guilty in Danbury Superior Court under the Alford Doctrine, meaning that he does not admit guilt but acknowledges that the prosecution has enough evidence to convict him at trial, the Courant said.
Benjamin Seitz died July 7 after his father forgot to drop the toddler at day car and left him for hours in his car on a hot day. Kyle Seitz discovered his son’s body after driving to day care at the end of the work day and learning that his son had never been dropped off that day. He rushed Benjamin to Danbury Hospital, where his son was pronounced dead.
An autopsy found that Benjamin Seitz died of hyperthermia caused by environmental exposure, and his death was ruled a homicide in August.
Kyle Seitz was charged with negligent homicide in November and pleaded not guilty.
Benjamin’s mother Lindsey Rogers-Seitz said she forgave her husband, and started a crusade for car safety regulations and laws to prevent similar incidents.
Seitz is scheduled to be sentenced April 9, where he faces a year in prison on the charge of criminally negligent homicide, the Courant said.
But according to the News Times, State's Attorney Stephen Sedensky said that he expected the judge to issue a suspended sentence and that Seitz would serve no prison time.
